By checking the box to the left of the "I accept the Terms & Conditions and Privacy Policy" statement on the checkout page on GadgetsGo.com, you (hereinafter "Customer", "you", "your") agree to be bound by the terms and conditions stated below. GadgetsGo.com (hereinafter "GadgetsGo", "we", "us", "our") and Customer agree that the following terms and conditions are the exclusive terms governing the sales transaction between Customer and GadgetsGo. Any attempt to alter, supplement, modify or amend these terms and conditions by the Customer will be considered a material alteration of this agreement and, therefore, are null and void. In addition, these terms and conditions are subject to change at any time, without prior written notice. Therefore, Customer agrees to read these terms and conditions carefully each time Customer places an order with or accepts delivery of any goods from GadgetsGo.

Shipping Policy

We strive to ship the SAME OR NEXT BUSINESS DAY, but sometimes may be longer for various really good reasons. Unless you choose Rush Order, GadgetsGo does not guarantee same day shipping. But, we will try!

GadgetsGo does not usually process orders during weekends, but sometimes we get super motivated and work anyway.

No deliveries will be made on Saturday unless your order is shipped with USPS, FedEx Home Delivery, or you have paid for UPS or FedEx overnight service with a Saturday surcharge. No deliveries will be made on Sunday unless your order is shipped with a USPS Sunday surcharge.

Exact delivery times to Hawaii, Alaska, Puerto Rico, other countries and planets cannot be guaranteed unless you ship with a FedEx or UPS next day or second day service, or USPS Priority Mail Express.

We reserve the right to ship using a different carrier than the one you chose during checkout if the delivery time is the same or faster. If such equivalent shipping method is less expensive, GadgetsGo will not refund the cost difference.

We may forward your order to a fulfillment service for shipment.

Customs officials in international destinations may require payment of duties, taxes and/or customs fees in addition to your invoiced amount, and Customer is solely responsible for payment of them.

  • FedEx Ground or Home Delivery: Delivery within 1 to 7 business days + 2 to 48 hours to process the order.
  • FedEx Express Saver: Delivery within 3 to 4 business days + 2 to 48 hours to process the order.
  • FedEx 2Day: Delivery within 2 business days + 2 to 48 hours to process the order.
  • FedEx Standard Overnight: Delivery within 1 business day + 2 to 48 hours to process the order.
  • UPS Ground: Delivery within 1 to 7 business days + 2 to 48 hours to process the order.
  • UPS 3 Day Select: Delivery within 3 business days + 2 to 48 hours to process the order.
  • UPS 2nd Day Air: Delivery within 2 business days + 2 to 48 hours to process the order.
  • UPS Next Day Air: Delivery within 1 business day + 2 to 48 hours to process the order.
  • USPS First Class Mail: Delivery within 1 to 5 business days + 2 to 48 hours to process the order.
  • USPS Priority Mail: Delivery within 1 to 3 business days + 2 to 48 hours to process the order.
  • USPS Priority Mail Express: Delivery within 1 day + 2 to 48 hours to process the order.
  • USPS First Class Mail International, Priority Mail International: Delivery within 1 to 45 business days + 2 to 48 hours to process the order.
  • Oversized or heavy item delivery: Delivery within 3 to 5 business days + 2 to 48 hours to process the order.
  • USPS APO/FPO orders are welcomed! Delivery will take approximately 2 to 6 weeks plus 2 to 48 hours to process the order. (Due to military APO/FPO box size, 19" and larger monitors cannot be shipped via this method; please remove them from your shopping cart before proceeding.)
  • FedEx Express Saver
    • Not available to Hawaii, Alaska or Puerto Rico. If you have selected FedEx Express Saver as your preferred shipping option and attempt to checkout, we will ship with FedEx or UPS Ground.
    • Not all orders qualify for FedEx Express Saver. Determination of eligibility will be made based on order weight and dimensions.

Orders

An order is not binding upon GadgetsGo until it is accepted; GadgetsGo must receive payment before it will accept an order. Payment for product(s) ordered is due prior to shipment. Customer may make payment by the methods shown above, or some other method prearranged with GadgetsGo. You agree to pay the amount(s) due as specified on the invoice, and you agree to pay a late payment fee on all past-due sums at a rate of 1.5% per month or the highest rate allowed by law, whichever is greater.

Rush Order Processing

GadgetsGo will process your order super fast in front of non-rush orders for an additional fee, provided that the following conditions are met:

  • Order and credit card authorization is successfully completed before 1 PM Eastern US Time.
  • Your shipping address matches your credit card billing address (i.e. no alternate ship to address).
  • Rush Orders do not apply to Pre-Paid Check orders.

In all circumstances, GadgetsGo's maximum liability is limited to the Rush Order fee only. While GadgetsGo cannot guarantee same day shipment for all orders, it will put forth its best effort to ship all Rush Orders the same business day if the above conditions are met. Otherwise, we will refund your Rush Order fee.

Order status

GadgetsGo will keep you informed of your order status via e-mail. All tracking information will be emailed to your registered email address once your order has shipped (except when an APO/FPO is the shipping destination) and scanned by the carrier. You may also get your order status and other live updates if you registered by logging in to your account on our Web site.

Change Orders or Order Cancellations

You may request that an order be changed or cancelled, provided the order has not already been processed and shipped. To request an order change or cancellation, please reply to the email receipt you received or call us at 305-791-1101 during GadgetsGo's hours of operation. If you canceled an order before it processed or shipped, you will receive a credit for the full amount to your credit/debit card in approximately one to three business days.

Sales Tax

Sales tax is only required for orders shipping into states where we or our distributor or our fulfillment service has or may have nexus for state tax purposes under applicable laws.

  • All orders shipped within Florida will be charged state sales tax. Please note that the sales tax for Florida orders is calculated based upon the total price of the order, including shipping and handling. The tax imposed on shipping and handling is part of the state sales tax, not a separate tax.
  • All customers outside of Florida, New Jersey and Tennessee will not be charged any state sales tax. Therefore, there is no need to email or submit any reseller tax exemption form.
  • For Florida, New Jersey and Tennessee Resellers: Please place your first order as normal, and email GadgetsGo your reseller permit and this form with your Sales Order number, and upon approval, we will remove all tax from your order. 30-Day Money Back Guarantee, Refund Policy and Return Policy

At GadgetsGo, we offer you a 30-Day Money Back Guarantee. If you need to return your purchase, you may return it within 30 days from the original invoice date, unless another time period or policy is indicated on the product detail page. Your refund shall be for the price of the product, not including shipping cost. A Return Merchandise Authorization (hereinafter "RMA") number is required for all returns. If the reason for the return is an order discrepancy, for example an incorrect quantity, you must notify us within seven days from the invoice date in order to be eligible for a return.

Restocking fee: GadgetsGo will assess a 20% restocking fee against the Customer's account on all returns for refund, unless the product is defective. However, if a defective product proves to be in good working order after we inspect or test it, then the restocking fee shall apply. We charge this fee because of the significant time and labor cost to inspect and prepare the item for sale again. We do not simply put it on the shelf again. We open the packaging, verify all original contents are there and in perfect condition, test the product if necessary, prepare the item for sale again, and document the foregoing.

For a refund and reorder of the same product, a different model, or substitute product (returning new, unused items only), we are pleased to waive the 20% restocking fee.

No refunds or reimbursements on shipping charges: GadgetsGo will not refund to Customer the original shipping charges or reimburse the customer's cost to return to GadgetsGo. Shipping fees are paid for the services provided by and to the original carrier, not by GadgetsGo, are permanently used and irrecoverable, and thus are not returnable or refundable. Exception: If you paid for a guaranteed service, such as FedEx Priority Overnight, and the shipment was delivered late or incorrectly and is eligible for reimbursement by the carrier, then GadgetsGo will pass any reimbursement granted to you.

If a product is sold with free shipping, then the cost of shipping will be deducted from the refund amount.

Some GadgetsGo product detail pages state a return policy that differs from GadgetsGo's return policy set forth above. In the event of a conflict between GadgetsGo's return policy and those on such product page, then the return policy on the product page shall apply.

Product Return Procedure

  • To return a product in compliance with GadgetsGo's 30-Day Money Back Guarantee, you must follow the following procedure.
    Find your emailed order receipt, click reply, and answer the following questions:
    1. Reason for return
    2. A picture is worth a thousand words, so please take a photo of the retail packaging and contents. Attach the photo to your email reply.
    3. Is the package opened?
    4. If the product is used, describe its condition.
    5. Can you return the product exactly as you received it, with the original packaging and 100% of its contents?
    6. If you answered "no" to #5, what is missing?
    7. Would you like a refund, replacement, or different model?
    8. If refund, do you accept the 20% restocking fee as stated above? To repeat from above , for a refund and reorder of the same product, a different model, or substitute product (returning new, unused items only), we are pleased to waive the 20% restocking fee.
     If refund, and if this item was shipped FREE to you, we do not refund our cost of shipping to you, and the fee is a part of our cost to ship to you.
  • All RMA requests must be made following the procedures described above. GadgetsGo will not accept returns without prior authorization and an RMA number. Once issued, RMA numbers are valid for 15 days within which return products must be received by GadgetsGo. RMA numbers will not be extended or reissued. Customer should prominently display the RMA number(s) on the shipping label of boxes containing the returned product.
  • Customer is solely responsible for shipping any returned product to GadgetsGo or our vendor. Customer agrees to use only reputable carriers capable of providing proof of delivery and insurance for the entire value of the shipment. Customer agrees to bear all shipping and insurance charges and all risk of loss for the returned product during shipment.
  • Customer agrees that all returned products will be 100% complete, in re-saleable condition, and will include the original packaging material, manuals, blank warranty cards, and other accessories provided with the original shipment. If any component of the returned product is missing, then GadgetsGo's Return Procedure will be breached and GadgetsGo may in its sole and absolute discretion reject the entire return or choose to impose additional charges against the customer's account for replacement of the missing component(s).

Damaged Shipment Policy

Shipments with FedEx or UPS
If the order was shipped with FedEx, and it was damaged during transit, call FedEx at (800) 463-3339 or UPS here https://www.ups.com/content/us/en/resources/service/claims/hlp/damage_process.html. Give the rep your shipment tracking number and inform them of the shipment damage. Then, contact us and follow the return instructions above.

Shipments by truck
If your shipment arrived damaged, then you may accept or refuse delivery; it's your choice. Then follow these instructions:

If you accept delivery...

  1. Note the apparent damage on the delivery receipt in the presence of the driver. Be as specific as possible to assist us in processing the claim with the carrier. Get the driver to sign his acknowledgement of the damage.
  2. Contact us and inform us of the situation.
  3. We will work with the carrier to settle the claim.

If you refuse delivery...

  1. Note the apparent damage on the delivery receipt in the presence of the driver. Be as specific as possible to assist us in processing the claim with the carrier. Get the driver to sign his acknowledgement of the damage.
  2. Contact us and inform us of the situation.
  3. We will contact the carrier to verify that the damaged product is being returned to us. Please allow approximately two business days for verification. Once we verify shipment of the returned item, we will ship a replacement product to you.

If the damage is concealed, and you only notice the damage after accepting delivery, and did not get the driver to sign acknowledgement of the damage, then the claim is between you and the shipping company. We recommend that you retain the packaging for your claim with them. You may also wish to file a warranty claim with the manufacturer. Please contact the manufacturer using the method specified on the warranty paper inside the package.

Physical Damage Policy

Physical damage to any product purchased at GadgetsGo shall void warranty coverage. Physical damage includes but is not limited to improper handling and/or any other type of damage sustained by irregular usage.

Pre-sale and Post-sale Technical Support

GadgetsGo strives to provide advice and technical support to our customers to assist them in their purchase. However, we do not operate a repair center and do not employ factory-trained repair technicians. Therefore, if you have a problem with the operation of a product after you receive it, please contact the manufacturer directly. Safe Shopping Guarantee

Fair Credit Billing Act: We guarantee that every online transaction you make will be 100% safe. This means you pay nothing if unauthorized charges are made to your card as a result of shopping at our online store. Under the Fair Credit Billing Act, your bank cannot hold you liable for more than $50.00 for fraudulent charges. If your bank does hold you liable for any of this $50.00, we will cover the entire liability for you, up to the full $50.00. We will only cover this liability if the unauthorized use of your credit card resulted through no fault of your own from purchases made while using our secure server. Product Revisions

GadgetsGo is not responsible for changes or variations in product specifications and/or physical appearance. In the interest of our customers, GadgetsGo puts forth its best efforts to ensure that all product information is up-to-date and factual. Unfortunately there are varying determinates which, although infrequent, could cause the information on our Web site to become outdated without our immediate knowledge. This includes but is not limited to new versions or revisions, color deviations, retail package alterations and other variations that may be considered inconsequential by the manufacturer. Product Testing

GadgetsGo, like other e-tailers, ships items in the condition they were received from the original manufacturer/distributor. GadgetsGo does not conduct product testing before shipping any merchandise.

GADGETSGO MAKES NO REPRESENTATION OR EXPRESS WARRANTY WITH RESPECT TO THE PRODUCT EXCEPT THOSE STATED IN THIS DOCUMENT. GADGETSGO SHALL NOT, UNDER ANY CIRCUMSTANCES, BE LIABLE UPON A CLAIM OR ACTION IN CONTRACT, TORT, INDEMNITY OR CONTRIBUTION, OR OTHER CLAIMS RELATING TO THE PRODUCTS IT SELLS WHICH EXCEEDS THIS LIABILITY LIMIT. GadgetsGo SHALL NOT BE LIABLE FOR THIRD PARTY CLAIMS FOR DAMAGES AGAINST THE CUSTOMER, OR FOR MALFUNCTION, DELAYS, INTERRUPTION OF SERVICE, LOSS OF BUSINESS, LOSS OR DAMAGE TO EXEMPLARY DAMAGES, WHETHER OR NOT GadgetsGo HAS BEEN MADE AWARE OF THE POSSIBILITY OF SUCH CLAIMS OR DAMAGES.

Recordings

GadgetsGo does not consent to having any telephone calls recorded and reserves the right to terminate any call that is being recorded. Customer agrees not to record any call with GadgetsGo unless Customer has provided clear and conspicuous notice to GadgetsGo and has received prior written consent from GadgetsGo.

Risk of Loss

GadgetsGo will arrange for shipment of ordered product(s) to the Customer, Free On Board (F.O.B.) shipping point, meaning title to the product(s), excepting software, and risk of loss passes to the Customer upon delivery to the carrier. GadgetsGo reserves a purchase money security interest in the product(s) until its receipt of the full amount due. Customer agrees to allow GadgetsGo to sign appropriate documents on Customer's behalf to permit GadgetsGo to protect its purchase money security interest. Title to software will remain with the licensor(s). All software is provided subject to the license agreement of the software maker. Customer agrees to be bound by any software license agreement once the seal on the package is broken. GadgetsGo will advise Customer of estimated shipping dates, but GadgetsGo will, under no circumstances, be responsible for delays in delivery, and associated damages, due to events beyond its reasonable control, including without limitation, acts of God or public enemy, acts of federal, state or local government, fire, floods, civil disobedience, strikes, lockouts, and freight embargoes.

Governing Law and Jurisdiction

Any dispute arising out of or related to these Terms and Conditions or the sales transaction between GadgetsGo and Customer shall be governed by the laws of the State of Florida, without regard to its conflicts of law rules. Specifically, the validity, interpretation, and performance of this agreement shall not be governed by the United Nations Convention on the International Sale of Goods. GadgetsGo and Customer consent to the exclusive jurisdiction and the exclusive venue of the State Courts of the State of Florida, Miami-Dade County, to resolve any dispute between them related hereto, and the parities waive all rights to contest this exclusive jurisdiction and venue of such Courts. Finally, the Customer also agrees not to bring any legal action, based upon any legal theory including contract, tort, equity or otherwise, against GadgetsGo that is more than one year after the date of the applicable invoice.

Severability

If any provision contained in this agreement is or becomes invalid, illegal, or unenforceable in whole or in part, such invalidity, illegality, or unenforceability shall not affect the remaining provisions and portions of this agreement, and the invalid, illegal, or unenforceable provision shall be deemed modified so as to have the most similar result that is valid and enforceable under applicable Florida law.

Waiver

The failure of either party to require performance by the other party of any provision of this agreement shall not affect in any way the first party's right to require such performance at any time thereafter. Any waiver by either party of a breach of any provision in this agreement shall not be taken or held by the other party to be a continuing waiver of that provision unless such waiver is made in writing.

Entire Agreement

These terms and conditions, together with GadgetsGo's invoice regarding the products ordered by Customer, are the complete and exclusive agreement between GadgetsGo and Customer, and they supersede all prior or contemporaneous proposals, oral or written, understandings, representations, conditions, warranties, and all other communications between GadgetsGo and Customer relating to the subject products. This agreement may not be explained or supplemented by any prior course of dealings or trade by custom or usage.
